High Ropes Course and Adventure Park

  1. General

    1. These Booking Terms and Conditions apply to the booking of the Beamish Wild Centre Activities care of Beamish Hall LTD (“The Company”), located in Stanley, Co Durham.
    2. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by Beamish Hall LTD
    3. Beamish Wild Centre Activities care of Beamish Hall LTD reserves the right to make changes to the activities.
    4. These Booking Terms and Conditions contain important information regarding participation by you and members of your party and you acknowledge and agree that it is your responsibility to ensure all members of your party are aware of and accept these Booking Terms and Conditions.
    5. Any clerical, software or other errors or omissions in any booking confirmation or other documentation issued by The Company (including electronic documentation/correspondence) is subject to correction without any liability on the part of the Company.
  2. Booking Confirmation

    1. No booking shall be considered accepted unless confirmed in writing (or electronically) by The Company
    2. These Booking Terms and Conditions incorporate The Company’s Disclaimer and Risk Acknowledgement Form; you and each member of your party over the age of 16 will be required to sign The Company’s Disclaimer and Risk Acknowledgement Form prior to taking part in any activities. For participants under the age of 16 The Company’s Disclaimer and Risk Acknowledgement Form will be signed by a parent or legal guardian. Refusal to sign The Company’s Disclaimer and Risk Acknowledgement Form will prevent you or the participant(s) in your party from taking part in any activities and no refunds or compensation will be payable in such circumstances.
    3. You must inform The Company as soon as possible of any mistake or omissions in the booking confirmation or any other correspondence. The Company will take reasonable care to ensure you and your party start at the booked time and it shall be the responsibility of each participant to ensure they arrive in sufficient time. Late arrivals may not be permitted to take part in the booked activity and no refund or compensation will be payable in such circumstances.
    4. If any information you provided during the booking process proves to be false or misleading The Company shall declare that particular booking null and void and no compensation or refund will be payable by The Company.
    5. All bookings for discounted rates tickets must be accompanied by proof (student cards etc) upon arrival on site. Failure to produce the required documents will result in you or any members of your group paying a surcharge to the full price.
  3. Prices and Payment

    1. All prices are subject to change
    2. Subject to any terms agreed in writing between The Company and you, the charges will be calculated at our current rates and payment in full is required at the time of the booking. Payment can be made in cash, credit/debit card or company cheque.
    3. Final details, full payment, and number of attendees must be confirmed by client 14 days prior to event. Refunds cannot be made for the reduction in numbers or changes to the activities within 14 days prior to event.
  4. Cancellations

    1. You will be entitled to cancel your booking up 10 days prior to the event. Under this clause you shall be entitled to a full refund. No refund will be given for any cancellations occurring within 10 days prior to event.
    2. Any requests for cancellation must be made to the company in writing and all monies paid as deposits are non-refundable.
    3. The Company is entitled to cancel your booking at any time. In the event The Company decides to cancel your booking it will use reasonable measures to notify you as soon as possible. You shall be entitled to a full refund under this clause but no other compensation shall be payable.
    4. In the event it is necessary to close The Activity Centre due to causes beyond The Company’s control and in circumstances where your party has commenced the activities, you shall not be entitled to any refund. In these circumstances The Company may, but will not be obligated to, offer alternative dates at no extra cost.
  5. Liabilities

    1. Parking facilities are available at the site and any vehicles and contents are left at the owner’s risk.
    2. Except as otherwise stated in these Terms and Conditions any liability of The Company shall be limited to the refund of any payments made to The Company.
    3. Except as otherwise stated in these Terms and Conditions The Company shall not be liable for the loss or damage to any property or to any person as a result of participation in the activities.
    4. Nothing stated in these Terms and Conditions is intended to nor shall limit the liability of The Company in respect of death or personal injury resulted from the negligence of The Company or its employees, agents or contractors.
  6. Safety

    1. as an outdoor adventure activity centre we are obliged to enforce certain usage restrictions to ensure participant safety. The restrictions are as follows:
      • Minimum Height-4’5”/134 cm
      • Maximum Weight- 18 stone/115 kg
      • Minimum Age- 10 years old – An adult must be present for the duration of the activity with 10 to 16 year olds. Children will not be allowed to part in the activity without an adult present and no refund will be offered under this clause.
    2. The Company reserves the right to refuse admittance to any participant that does not meet the terms of these restrictions.
    3. The Company reserves the right to refuse admittance and remove a participant from the activities should it be deemed necessary. This includes participants that are deemed or suspected to be under the influence of drugs and alcohol.
    4. All participants are required to act responsibly and courteously at all times and respect The Company’s Staff and other participants. The Company shall be entitled to prevent from participating or remove from the activities any person displaying unsuitable behaviour.
    5. All participants are required to wear and use as instructed all Personal Protective Equipment provided by The Company. Failure to do so will result in removing the participant from the activities.
    6. The Ropes Course Activities Centre will remain open and operational in all weather conditions except gales, lightning, heavy snow or ice.
    7. All participants are required to certify that they do not suffer from any medical condition which would increase the risk of an accident or injury to themselves or others (including pregnancy).
    8. All participants are required to attend the induction brief scheduled for the session that they have booked in. It is the participant’s responsibility to be present at the agreed time and failure to do so will prevent him/her to take part in the activities.
    9. Participants must be dressed appropriately (see clause 7) and The Company reserves the right to refuse admittance to anyone who is not appropriately dressed.
    10. No refunds or compensation will be payable by The Company in the event any participant is not permitted to or decides not to undertake or complete the activities for the reasons set out in this clause.
  7. Clothing

    1. The Beamish Wild Ropes Activity Centre is a woodland-based adventure activity and there is always a chance that your clothing might get dirty or even slightly damaged, so we strongly recommend that you dress accordingly. The activities you will be taking part in include zipline, a powerfan descent, rope walks and other high wire adventures. Dress according to the weather to avoid being uncomfortable. We recommend that you wear ankle-supporting shoes. For your own safety we do not allow participants to wear flip-flops, sandals or other inappropriate footwear. Again, for your own safety we ask that all jewellery and piercings are removed or taped over for the duration of the activity. Long hair should be tied back and scarves are not permitted to be worn.
    2. The Company will not be responsible for any damage to or loss of clothing or other personal belongings as a result from participating in the activities.
  8. Miscellaneous

    1. If any of the Terms and Conditions are deemed to be illegal, invalid or unenforceable it shall be deleted from these Terms and Conditions and the remaining terms shall endure, remain in full force and continue to be binding and enforceable.
    2. Nothing in these Terms and Conditions shall confer on any third party any benefit or the right to enforce any of these Terms and Conditions.
    3. The above Terms and Conditions shall be governed and interpreted by English Law and any disputes shall be subject to the exclusive jurisdiction of the courts of England.
